The data we collect about you and how we collect it

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data)

We may collect, use, store and transfer the following types of personal data:

  • Technical data: including IP address used to connect your computer or mobile device to the internet, browser type and version, operating system and platform and other technologies on the devices you use to access this Website

Also, if you make an enquiry or submit a job application you will be asked to provide certain information including name, email address and telephone number

We do not collect sensitive data about you without your express consent and would only do so in accordance with data privacy laws

We only use your personal data where required for specific purposes. Most commonly, we will use your personal data in the following circumstances:


  • To perform the contract we are about to enter into or have entered into with you; 

  • To contact you with business related information that we consider may be of interest to you; 

  • Where it is necessary for our legitimate interests (e.g. conducting our business in an efficient and compliant manner and the overall promotion of our business) and your interests and fundamental rights do not override those interests; and where we need to comply with a legal or regulatory obligation. We do not sell, rent or exchange your personal information with any third party for commercial reasons.

The types of personal data we process

  • We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data) unless we have your explicit consent to do so. Please note that if you do fail to provide personal data we may not be able to perform the contract we have, or are entering into with you (for example, to provide you with services).


Lawful Processing of Personal Data


For processing of data to be lawful under the General Data Protection Regulation (GDPR) Commercial Sense Limited use;

  • Consent: individual(s) give clear consent for Commercial Sense Limited to process their data for a specific purpose

  • Contract: the processing is necessary for a contract Commercial Sense Limited has with the individual(s), or because the individual(s) have asked Commercial Sense Limited to take specific steps before entering into a contract

  • Legal Obligation: the processing is necessary for Commercial Sense Limited to comply with the law (not including contractual obligations)

  • Legitimate Interests: the processing is necessary for the individual(s) legitimate interests or the legitimate interests of a third party unless there is good reason to protect the individual(s) data which overrides those legitimate interests


Sharing your personal data

We may share your personal data with the following:


  • Our service providers and agents (including their sub-contractors) or third parties which process information on our behalf (e.g. internet service and platform providers, payment processing providers, software application providers and those organisations we engage to help us send communications to you) so that they may help us to provide you with the services and information you have requested or which we believe is of interest to you.

  • Third parties where you have a relationship with that third party and you have consented to us sending information (for example other professional advisers, social media sites or other third-party application providers).

  • Credit reference and fraud prevention agencies; 

  • Regulators to meet Commercial Sense’s legal and regulatory obligations;

  • Any third party in order to meet our legal and regulatory obligations, including statutory or regulatory reporting or the detection or prevention of unlawful acts; 

  • Our professional advisors and auditors for the purpose of seeking professional advice or to meet our audit responsibilities; 

  • Another organisation if we choose to sell, transfer or merge parts of our business or assets; 

  • Another organisation to whom we may transfer our letter of engagement with you or your employer/company or sub-contract some of the services we have agreed to carry out for you;

  • Government departments where reporting is mandatory under applicable law. 


We may share non-personally identifiable information about the use of our website, applications, products or services publicly or with third parties but this will not include information that can be used to identify you.

Data Security

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used, or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

We will retain your personal data for the duration of our business relationship and afterwards for a minimum of 6 years as required by the FCA or as long as is necessary and relevant for our legitimate business purposes, in accordance with the relevant Commercial Sense Ltd policies or as otherwise required by applicable laws and regulations. Where we no longer need your personal information, we will dispose of it in a secure manner (without further notice to you).

In some circumstances we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.


Data Retention

We maintain a specific data retention policy to ensure that we only retain your personal data for as long as necessary to fulfil the purpose we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those through other means, and the applicable legal requirements.


International Transfers

We may from time to time wish to transfer personal data to our other group entities or third parties supporting the operation of our business which may involve transferring data outside the European Economic Area (EEA). Prior to making any such transfer of personal data, we will take the necessary steps to ensure that a similar degree of protection is afforded to your personal data in accordance with the applicable data privacy laws.

  • The right in relation to automated decision making and profiling – this allows individuals to object to their data being used in an automated individual decision-making process (making a decision solely by automated means without any human involvement) and profiling (automated processing of personal data to evaluate certain things about an individual). Profiling can be part of an automated decision-making process.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.


We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.


We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
